2010 marked the first year that retaliation claims under federal law became the most frequently filed charge with the Equal Employment Opportunity Commission. Aside from the prevalence of retaliation claims, they are more difficult to defend than discrimination claims and often result in higher damages awards. This interactive briefing will address: 1) the evolving standards and pitfalls related to retaliation claims; 2) policies, practices and tips for preventing such claims; and 3) strategies for defending these potentially difficult claims.
