2010 marked the first year that retaliation claims under federal law became the most frequently filed charge with the Equal Employment Opportunity Commission. Aside from the prevalence of retaliation claims, they are more difficult to defend than discrimination claims and often result in higher damages awards.

The Family and Medical Leave Act (“FMLA”) was both overhauled and expanded recently. The Department of Labor released a comprehensive revision of its regulations, and virtually every area of FMLA administration has changed in some way as a result. Also, Congress passed an amendment to the FMLA creating two brand-new types of leave aimed at those with family members in military service. Our Speaker Neil Dishman will explain these changes to attendees and give tips on coming into compliance with the new laws.

Patty Mehren of Seyfarth will define types of harassment issues, including sexual harassment, which includes hostile work environment. Things that get employers in trouble, even if not against the law. That would also include actions that employees could perceive as "bullying." There are no laws currently in Illinois that specifically address bullying of employees but certainly such types of acts could be considered hostile work environment.
